Welcome to our mobile application. All Trans Software Inc is committed to maintaining robust privacy practices for our users. This Mobile Application is maintained as a service to our customers. By using this Mobile Application, you agree to comply with and be bound by the following terms and conditions of use. 

Please review the Privacy Statement carefully. If you do not agree to these terms and conditions, you should not use this mobile application. 

WHAT IS PERSONALLY IDENTIFIABLE INFORMATION?

“Personally identifiable information” is any data that could potentially be used to identify a particular person, such as a person’s name, address, e-mail, user ID, social security number, etcetera.

HOW IS INFORMATION COLLECTED, USED, AND DISCLOSED?

We may request that you voluntarily supply information within the Applications to provide services or to enhance your experience. Providing this information is up to you, however if you choose to do so, it must be sent in an encrypted fashion that sufficiently protects PHI/PII. Mechanisms to send data securely vary depending on the sender’s electronic mail system, network, and system configuration, etcetera, and are the responsibility of the sender. We do not collect any personally identifiable information without your consent.

AllTrans is a Business Associate performing services on behalf of Covered Entities. As such, your PII may be provided to AllTrans for AllTrans to provide the appropriate services in accordance with contractual obligations to our customers. Requests for updates or deletion of PII must be coordinated through the Covered Entity that collected the information, as such requests may impair AllTrans ability to provide agreed-upon services.

If you have voluntarily provided information, you consented to the collection and use of your personally identifiable information as described in this Privacy Statement. In certain circumstances, AllTrans may share information you voluntarily provide us with trustworthy business partners. We do not sell or rent personal information collected through the Applications. AllTrans may also provide certain statistics about site visitors, including volume, traffic patterns, and related site information to reputable third-party vendors, but these statistics will not include any personally identifiable information.

AllTrans may also disclose personally identifiable information in special cases when we have a good faith belief that such disclosure is necessary to: (a) comply with legal requirements; (b) defend and protect company property; (c) enforce Terms and Conditions of Use of the Applications; or (d) protect the interests of our users or others.

VISITING THE SITE FROM OUTSIDE THE U.S.

The Applications are operated in the United States. This Privacy Statement is intended to cover the collection of information within the Applications from United States residents only. If you are located outside of the United States, please be aware that any information you provide to us will be transferred to the United States. By using the Applications, participating in any of our services and/or otherwise providing us with your information, you understand and agree that your information may be moved to, accumulated and processed in the United States where our servers are located and our central database is operated and such information may be transferred to our third parties with whom we share such information as described in this Privacy Statement.

CHILDREN’S POLICY

The Applications are restricted to individuals eighteen (18) years of age and older. The Applications are not designed for or targeted at children. No one under the age of thirteen (13) may provide any information on the Website, within our applications. While our applications might be used in connection with services provided to minors, an adult guardian is responsible for entering any appropriate information into the Application. We do not knowingly collect and maintain information from children under the age of thirteen (13). If we are informed that a user is under the age of thirteen (13), we will immediately close that user’s account and delete such information. Should you know that a user is under the age of thirteen (13), please contact us immediately.

HOW DO WE PROTECT YOUR INFORMATION?

We are painstaking in our efforts to protect your personally identifiable information. AllTrans has security measures in place to protect the loss, misuse, and alteration of the information under AllTrans control. AllTrans employs strict security measures to safeguard personally identifiable information. This includes, among other things, using firewalls, encryption, intrusion detection and site monitoring. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure, so despite our efforts, we cannot ensure or warrant the security of any information you transmit to us or receive from us. Internally, we will restrict access to your personally identifiable information to employees who need access to the information to do their jobs. These employees are committed to our privacy policies.

As a provider of services to the healthcare industry, AllTrans has implemented programs to address the transaction standards, and the privacy and security implications of the rules promulgated pursuant to the Health Insurance Portability and Accountability Act of 1996 with respect to protected health information.

HOW CAN YOU HELP PROTECT YOUR INFORMATION?

If you are using the Applications for which you registered and created a password, we recommend that you never divulge your password to anyone. We will never ask you for your password in an unsolicited manner. Also remember to sign out of the registered site and close your browser window when you have finished working. This is to ensure that others cannot access your personal information and correspondence if others have access to your computer.

The app does use third party services that may collect information used to identify you.

If you choose to refuse our cookies, you may not be able to use certain portions of this Service. Log Files We use IP addresses to analyze trends, administer the site, track user movement, and log information for security purposes. IP addresses are not linked to personally identifiable information. All such collected information will be available for review by the Customer, to enable Customer to track usage by the various Users. Links Our APP may contain links to other sites. Please be aware that ATS is not responsible for the privacy practices of such other sites. We encourage our users to be aware when they leave our site and to read the privacy statements of each Web site that collects personally identifiable information. Security We value your trust in providing us with your Personal Information, thus we are striving to use commercially acceptable means of protecting it. But remember that no method of transmission over the internet, or method of electronic storage is 100% secure and dependable, and we cannot guarantee its absolute security. 

MISUSE AND TERMINATION 

Misuse of ATS’s APP Service such as by hacking, spamming, solicitations whether commercial or non-commercial, or transmission of information that is harmful, obscene, harassing, libelous or illegal is forbidden. Any such activity, and any other violation of these Terms and Conditions and Privacy Statement or the Master Services Agreement by a Customer or User may, in ATS’s discretion, result in termination of Hosted Services by ATS to the Customer or User without notice, and entitle ATS to all other remedies available under applicable law. Without limiting the generality of the foregoing, termination may also result if ATS has reason to believe that a customer or user is not in compliance with laws governing privacy or disclosure of health information or that a patient consent has been withdrawn or revoked. Finally, failure of a Customer to pay any sum due and owing to ATS under the Master Services Agreement for services which ATS has performed in conformance with the specifications in that Agreement or otherwise shall constitute grounds for termination of the Hosted Services.

NO WARRANTIES 

This APP is provided “as-is” without any representations or warranties, express or implied. ATS makes no representations or warranties in relation to the App, or the information and materials provided on this App. Without prejudice to the generality of the foregoing paragraph, ATS does not warrant that: 

    • this App will be constantly available, or available at all; or 
    • the information on this App is complete, true, accurate or non-misleading. Nothing on this App constitutes, or is meant to constitute, advice of any kind. [If you require advice in relation to any [legal, financial, or medical] matter you should consult an appropriate professional.] Limitations of liability Page 3 ATS will not be liable to you (whether under the law of contact, the law of torts or otherwise) in relation to the contents of, or use of, or otherwise in connection with, this App:

Other parties You accept that, as an LLC entity, ATS has an interest in limiting the personal liability of its officers and employees. You agree that you will not bring any claim personally against ATS officers or employees in respect of any losses you suffer in connection with the APP unless ATS engages in intentional wrongdoing or gross negligence. Without prejudice to the foregoing paragraph, you agree that the limitations of warranties and liability set out in this APP disclaimer will protect ATS officers, employees, agents, subsidiaries, successors, assigns and subcontractors as well as ATS. Unenforceable provisions If any provision of this Privacy Statement is, or is found to be, unenforceable under applicable law, that will not affect the enforceability of the other provisions of this Privacy Statement 

INDEMNITY

You hereby indemnify ATS subject to the state tort liability limits contained in Chapter 466 of the Minnesota Statues and undertake to keep ATS indemnified against any losses, damages, costs, liabilities and expenses including without limitation legal expenses and any amounts paid by ATS to a third party in settlement of a claim or dispute on the advice of ATS legal advisers incurred or suffered by ATS arising out of any breach by you of any provision of these terms and conditions or arising out of any claim that you have breached any provision of these terms and conditions. Breaches of these terms and conditions Without prejudice to ATS other rights under these terms and conditions, if you breach these terms and conditions in any way, ATS may take such action as ATS deems appropriate to deal with the breach, including suspending your access to the website, prohibiting you from accessing the website, blocking computers using your IP address from accessing the website, contacting your internet service provider to request that they block your access to the website and/or bringing court proceedings against you. 

VARIATION 

ATS may revise these terms and conditions from time-to-time. ALL TRANS APP PERMISSIONS FOR DRIVERS

AllTrans is a B2B app used by the non-emergency medical transportation (NEMT) industry to track and manage the transport of medical patients. NEMT drivers use the AllTrans app to view and perform their list of scheduled trips. As these trips are being serviced, NEMT dispatchers can see where their drivers are and the ETA of their next patient pickup or drop-off.

NEMT dispatchers need to be able to see where their drivers are in the middle of the workday, even if their drivers are using another app (such as Mail or Google Maps). To provide accurate ETAs to hospitals and doctor’s offices, our app needs to be able to determine and share the real-time geolocation of the driver for the duration of their workday. This is a line of business app used by the medical community to track and manage patients coming to and from doctor’s visits.

To get the most out of using the AllTrans app, we request access to your location data. You can change your security preferences at any time in your phone’s settings.

These permissions are never used outside your normal use of the app. We take your data privacy seriously.

LOCATION DATA

AllTrans uses your phone’s location services to give you a great ride experience. We only access your location if the AllTrans app is running on your phone AND the user/driver is logged into the app. If you close the app OR log out of the app, we will not access that info.

Sharing your location data with us turns background location sharing on. Background location sharing means you are sharing your location with us even when the app is not visible on your screen.

You can control background location sharing in your AllTrans app settings.

To do so:

  • Open the [Settings] APP.
  • Select [Apps]
  • Select the [AllTrans App]
  • Scroll to [Permissions]
  • Choose [Location]
  • Select the access level you are comfortable with

If you turn background location sharing off, All Trans will not function as designed since the core feature of the AllTrans mobile app is to allow dispatchers to view their fleet’s location and ETAs in real time.

CAMERA & CONTACTS

If you want to upload pictures for vehicle inspections, we will ask for access to your camera.
